Terms of Service

Effective date: October 7, 2026 · Last updated: October 7, 2026

1. Agreement to These Terms

These Website Terms of Service ("Terms") govern your use of www.blacktie-eventrentals.com and any related pages, forms, and online content (the "Site") operated by Black Tie Event Rentals, LLC ("Black Tie," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. Bookings Are Governed by the Rental Agreement

These Terms cover your use of the Site only. They do not create a rental. A booking is confirmed only when you have signed our Rental Agreement and related documents and we have received the required deposit.

Once you book, the Rental Agreement, including its incorporated policies on cancellation, damage and prohibited use, and delivery and site requirements, governs the rental. If anything in these Terms conflicts with your Rental Agreement, the Rental Agreement controls.

3. Eligibility

You must be at least 18 years old to submit an inquiry or request a booking through the Site. By doing so, you confirm that you are 18 or older and that the information you provide is accurate.

4. Inquiries and Quotes

  • Submitting an inquiry does not reserve a date or create an obligation for either party.

  • Availability shown or discussed is not guaranteed until your booking is confirmed as described in Section 2.

  • Quotes are based on the information you provide, including event date, duration, location, guest count, and site conditions. If that information changes or proves inaccurate, the quote may change.

  • Unless stated otherwise, a written quote is valid for 14 days.

5. Pricing, Descriptions, and Images

The Site does not display pricing. Pricing depends on the details of your event, including date, duration, location, guest count, and site conditions, and is provided in a written quote on request. Your quote states the total price for the services requested, including all mandatory charges, other than applicable taxes. Optional add-ons are itemized separately and are never required.

We work to describe our units and services accurately. Photographs, renderings, and styling examples on the Site are illustrative. Décor, florals, and furnishings vary by event and package, and the specific unit delivered may differ in minor respects from those pictured. We may correct errors in pricing or descriptions at any time before a booking is confirmed.

6. Communications

By submitting an inquiry, you agree that we may contact you by email, phone, or text message about that inquiry and any resulting booking. We will send promotional text messages only if you separately and expressly agree to receive them. You can unsubscribe from marketing emails using the link in any message, and stop promotional texts by replying STOP. Reply HELP to any text message for help. Message and data rates may apply. Consent to marketing is never a condition of booking.

7. Acceptable Use

You agree not to:

  • Submit false, misleading, or fraudulent inquiries or information;

  • Use the Site for any unlawful purpose or in violation of these Terms;

  • Attempt to gain unauthorized access to the Site, its systems, or accounts;

  • Introduce viruses, malware, or other harmful code;

  • Scrape, harvest, or collect content or data from the Site by automated means; or

  • Interfere with the Site's operation or security.

8. Our Intellectual Property

The Site and its content, including the Black Tie Event Rentals name, logos, bow tie mark, photographs, text, and design, are owned by or licensed to Black Tie and protected by intellectual property laws. You may view and print pages for personal, non-commercial use in connection with planning an event. You may not copy, reproduce, modify, distribute, or use our content or marks for any other purpose without our written permission.

9. Reviews, Photos, and Content You Share

If you send us or post to us content such as a review, testimonial, comment, or photograph ("Your Content"), you confirm you have the right to share it, and you grant Black Tie a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and adapt Your Content, with or without attribution, for operating and promoting our business. You remain the owner of Your Content, and this license lasts only until you ask us to stop.

If you tag us in a post on social media, we will ask your permission before reposting it on our own channels. You may ask us to stop using Your Content at any time, for any reason, by contacting us using the details in Section 20. We will confirm your request, stop using the content, and remove it from the channels we control within 30 days. We may be unable to recall materials already printed or distributed, or copies that others have shared, and we may retain copies where we are required to do so by law.

Do not share content that is unlawful, defamatory, infringing, or that shows other people who have not agreed to be shared. We may decline to publish or may remove any content at our discretion.

10. Third-Party Services and Links

The Site may link to or rely on third-party services, including social media platforms, review websites, and the booking and payment platform we use for quotes, contracts, and invoices. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and privacy policies.

11. Privacy

Our Privacy Policy, available on the Site, explains how we collect, use, and share personal information and is part of these Terms.

12. Accessibility

We want the Site to be usable by everyone. If you have difficulty accessing any part of the Site, contact us using the details in Section 20, and we will provide the information you need in another format and work to address the issue.

13. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, BLACK TIE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. Warranties and obligations relating to a rental are set out solely in the Rental Agreement.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BLACK TIE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). This Section applies to use of the Site only; liability relating to a rental is governed by the Rental Agreement. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Black Tie and its members, officers, and agents from claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or from Your Content.

16. Governing Law and Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO A JURY TRIAL AND TO BRING A CLAIM IN COURT. IT REQUIRES CLAIMS TO BE BROUGHT ON AN INDIVIDUAL BASIS. IT ALSO GIVES YOU A RIGHT TO OPT OUT.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

16.1 Informal resolution first. Before starting arbitration or filing any claim, you agree to contact us at info@blacktie-eventrentals.com and give us at least 30 days to resolve the dispute informally. We will do the same before bringing a claim against you.

16.2 Small claims court. Either party may instead bring a qualifying individual claim in small claims court.

16.3 Binding arbitration. Except for claims brought in small claims court, any dispute arising out of or relating to these Terms or your use of the Site that is not resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. Judgment on the award may be entered in any court with jurisdiction.

16.4 Costs. Black Tie will pay all filing, administrative, and arbitrator fees that exceed what you would have paid to file the same claim in a California state court. Each party otherwise bears its own attorneys' fees, except where a statute provides otherwise.

16.5 Location and format. Arbitration will take place in Los Angeles County, California, or in the county where you live, whichever you choose. At your election, the arbitration may be conducted by telephone, by video, or on written submissions only.

16.6 Your right to opt out. You may opt out of this arbitration agreement by emailing info@blacktie-eventrentals.com within 30 days of first agreeing to these Terms, stating your name and that you decline arbitration. Opting out affects no other part of these Terms and will not affect your ability to do business with us. If you opt out, Section 16.8 applies instead.

16.7 Individual claims only. Claims must be brought individually. Neither party may bring a claim as a plaintiff or class member in any class, collective, consolidated, or representative action, and the arbitrator may not consolidate claims or preside over any form of representative proceeding. This paragraph does not apply to any claim that cannot be waived under applicable law, including any claim for public injunctive relief. If this paragraph is found unenforceable as to a particular claim, that claim is severed and resolved under Section 16.8, while all remaining claims proceed in arbitration.

16.8 If arbitration does not apply. If you opt out, or if this arbitration agreement is found unenforceable as to a particular claim, that claim will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and both parties consent to their jurisdiction.

16.9 Understanding arbitration. Arbitration is different from court. There is no judge or jury, discovery is more limited than in litigation, and review of the arbitrator's decision is very limited.

17. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on the Site with a revised "Last updated" date and apply from that date. Changes will not apply to a booking already confirmed under a signed Rental Agreement.

18. Suspension of Access

We may suspend or restrict access to the Site, or decline an inquiry, if we reasonably believe these Terms have been violated or to protect the Site, our business, or others.

19. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a transfer of our business. These Terms, together with the Privacy Policy, are the entire agreement between you and Black Tie regarding the Site.

20. Notice to California Users and Contact

Under California Civil Code Section 1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
